End User License Agreement

End User License Agreement

This EULA constitutes the agreement between you and VipAds LLC governing the right to use the FenixUz Application.

01Grant of License

VipAds LLC hereby grants you a personal, royalty-free, revocable, non-exclusive, non-sublicensable, and non-transferable license to use the FenixUz Application, subject to the following conditions:

  • You use the Application in compliance with the Terms of Service of the relevant mobile platform;
  • You preserve all copyright and trademark notices included in the Application;
  • You use the Application solely on your personal mobile device.

02Restrictions

Under this EULA, you shall not engage in the following actions, except as permitted by law and the GPL-2.0+ license:

  • License, lend, lease, or sell the Application;
  • Rebrand and distribute the Application under another name (forks must be released under a separate name);
  • Circumvent the Apple/Google payment systems (where Premium sales are involved);
  • Represent the FenixUz logo as belonging to your company.

03GPL-2.0+ Section

The FenixUz source code is published under the GNU General Public License v2.0 or any later version. Binary files downloaded via the Apple App Store or Google Play are compiled and distributed by VipAds LLC, but the source code remains open at all times.

In the event of a conflict between the distribution terms of Apple and Google and the terms of GPL-2.0+, the terms of GPL-2.0+ shall prevail β€” meaning that you shall be entitled to equal rights in the source code and may distribute it to others.

04Apple App Store Addendum

If you obtained the Application through the Apple App Store, the following additional provisions shall apply (in accordance with Apple's requirements):

  • This EULA is an agreement between you and VipAds LLC. Apple Inc. is not a party to this agreement.
  • The license is limited to the Usage Rules set forth in the Apple Media Services Terms.
  • VipAds LLC is solely responsible for the operation and quality of the Application.
  • Apple provides no warranty for FenixUz and shall provide no technical support.
  • VipAds LLC bears responsibility for any product liability claims.
  • VipAds LLC is responsible for claims regarding infringement of third-party intellectual property rights.
  • Apple and its subsidiaries are deemed third-party beneficiaries of this EULA and shall have the right to enforce its terms against you.
  • You hereby warrant that you are not on any export-control restricted list and do not reside in a sanctioned country.

05Google Play Addendum

For Applications downloaded via Google Play, the Google Play Developer Distribution Agreement and Google Play Terms of Service shall also apply. Google LLC assumes no obligation toward you with respect to refunds, third-party complaints, or technical service.

06Automatic Updates

The Application is updated from time to time. Updates are delivered via the automatic update mechanisms of Apple/Google. You may decline an update; however, security support for older versions may cease 6 months thereafter.

07Termination of License

The license shall terminate in the following circumstances:

  • You uninstall the Application from your device;
  • You breach this EULA;
  • VipAds LLC has provided you with written notice of termination.

Upon termination, you must immediately uninstall the Application from your device. The right to obtain the source code under GPL-2.0+ shall not terminate.

08Technical Support

VipAds LLC provides technical support on a "best-effort" basis through support@fenixuz.uz. Neither Apple nor Google nor your mobile carrier is obligated to provide support for FenixUz.

09Trademarks

Apple, App Store, iOS, and the Apple logo are trademarks of Apple Inc. Google, Google Play, and Android are trademarks of Google LLC. Telegram and the Telegram logo are trademarks of Telegram FZ-LLC. FenixUz and fenixuz.uz are trademarks of VipAds LLC.

10Governing Law

This EULA shall be construed in accordance with the laws of the Republic of Uzbekistan (with the exception of the provisions relating to the Apple App Store, which shall be governed by the laws of the State of California). The full dispute resolution procedure is set forth in Section 17 of the Terms of Service.
